1. PREAMBLE AND DEFINITIONS

1.1 Definitions

In these General Terms and Conditions of Sale (hereinafter "GTC"), the following terms shall have the meanings assigned to them below:

The Company, LAUYAN SOFTWARE, is a limited liability company (SARL) with a share capital of €7,500, registered with the RCS of Versailles under number 482806155. Its intra-community VAT number is FR24482806155. The registered office is located at 16 RUE DU GENERAL DE GAULLE 78120 RAMBOUILLET. 3. PURPOSE AND SCOPE

These GTC are intended to define the conditions under which the Company offers its Services to professional Users (B2B) via the Site. They apply to all orders placed on the Site, to the exclusion of all other conditions, including those in force for in-store sales or through other distribution and marketing channels.

4. CHARACTERISTICS OF SERVICES AND ACCESS

The Services offered by the Company consist of generating personalized legal documents for websites, such as privacy policies, terms of use, cookie policies, and general terms and conditions of sale. Access to the Services is exclusively online, without account creation, via a detailed ordering process described below.

5. PRICES AND PAYMENT TERMS

The prices of the Services are indicated in euros, all taxes included (TTC). Payment for the Services is made via Stripe Checkout, which accepts the following payment methods: credit card, PayPal, Apple Pay, Google Pay, SEPA, iDEAL, Bancontact, Klarna, EPS, Blik, Multibanco, Revolut Pay, MB Way, MobilePay, Satispay, Billie, Pix. No payment data is stored by the Company.

6. SERVICE PROVISION PROCESS

The ordering process on the Site is as follows:

  1. The User provides information about their site/company via a 7-step assistant form. An optional AI scanner can automatically pre-fill most fields from the site's URL.
  2. The User selects the type of document or a package and previews an excerpt of the document before purchase.
  3. Payment is made via Stripe Checkout.
  4. After payment confirmation, the document is generated by artificial intelligence and sent to the email address provided by the User, accompanied by a secure download link.

7. RIGHT OF WITHDRAWAL

In accordance with Article L221-28 of the Code de la consommation, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium, the execution of which has begun after the consumer's prior express consent and express waiver of their right of withdrawal.

8. LEGAL AND COMMERCIAL WARRANTIES

The Services benefit from the legal warranties of conformity and hidden defects provided for by Articles 1641 and following of the Code civil. The Company does not offer any additional commercial warranty.

9. LIABILITY AND EXCLUSIONS

The Company undertakes to provide the Services in accordance with industry standards and applicable regulations. However, the Company's liability cannot be engaged in cases of force majeure or fault of the User. The Company shall not be held liable for indirect damages resulting from the use of the Services.

10. FORCE MAJEURE

The Company shall not be held liable for the non-performance of its obligations in the event of force majeure as defined by French jurisprudence.

11. INTELLECTUAL PROPERTY

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of the Company.

12. PERSONAL DATA PROTECTION

The Company, as the data controller, undertakes to comply with the legislation in force regarding the protection of personal data, notably the General Data Protection Regulation (GDPR). The User has rights of access, rectification, erasure, restriction, opposition, and portability of their data, which they can exercise by contacting the Company.

13. DISPUTES AND APPLICABLE LAW

These GTC are subject to French law. In the event of a dispute, the parties agree to seek an amicable solution before referring the matter to the competent courts. The User is informed of the possibility of using the European Commission's Online Dispute Resolution platform accessible at the following address: https://ec.europa.eu/consumers/odr.

14. CUSTOMER SERVICE AND MEDIATION

For any questions or complaints, the User can contact the Company's customer service by email at contact@weblegal.ai or by phone at +33972232805. In the event of an unresolved dispute, the User may resort to a consumer mediator to attempt to find an amicable solution.
